This Privacy Policy describes how Summit United Corporation dba TMG Industrial USA and its affiliates (“TMG,” “we,” or “us”) collects, uses, and discloses information it collects from you, as well as how it protects and secures your data. This Privacy Policy applies generally to Personal Information (as defined below) that we collect, use, and disclose, but shall be superseded by any specific terms and conditions set forth in any agreement with us related to particular products, services, or collected data. This Privacy Policy applies only to information collected, used, and possessed by us and our controlled affiliates. It does not apply to any independent dealers or distributors, who may have their own privacy policies applicable to information that they collect from you.

1. What Type of Personal Information Do We Collect?
Personal Information
We collect various types of "Personal Information," defined as any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an identified or identifiable natural person or household. B. Commercial Information, e.g., Records of equipment, software, and other products or services purchased, considered, or returned, equipment registrations, customer service inquiries, customer account information, and consumer histories and tendencies, drawn from your transactions with us.
C. Internet and Electronic Network Activity, e.g., Browsing history, search history, and information regarding your interaction with any of our websites, applications, or advertisements, including the sites you visit just before and just after leaving our websites.
D. Financial Information, e.g., Credit card information, account numbers, credit scores, equipment financing and leasing information, and information you might provide when making or contemplating a purchase.
E. Geolocation Data, e.g., Information based on your delivery address, your computer's physical location, the address of the store at which you make purchases, or other location-based data.
F. Professional, Employment, and Education Information, e.g., Your work history, educational background, current employment status, current place of employment, professional references, biographical details, and other information you might provide when applying for a position with us.
G. Analytics and Inferences, e.g., Analytic results or inferences drawn from any of the above categories of information to create a profile about you reflecting your preferences, characteristics, behavior, attitudes, abilities, or aptitudes.
Sensitive Personal Information
Some of the Personal Information detailed above may constitute "Sensitive Personal Information," such as:
- your social security number, drivers license number, state identification number, or passport number;
- your account names and debit/credit card numbers in combination with security/access codes, passwords, or other credentials allowing access to an account; and
- precise geolocation data (e.g., within 1850 feet).
2. Where and How Do We Obtain Personal Information?
We obtain Personal Information in a variety of ways, such as:
- directly from you, via in-person interactions or online forms you fill out;
- indirectly from you, via automated technologies such as cookies, pixel tags, browser analysis tools, server logs, and web beacons;
- from our authorized dealers and distributors;
- from our service providers; and
- from public sources, such as the Internet or government agencies.
3. How Will We Use Your Personal Information?
Subject to the limitations set forth in this Privacy Policy as well as relevant laws and regulations, we may use your Personal Information for a variety of purposes (the "Purposes"), such as:
- Orders and Service Requests. To fulfill orders, handle payments, and facilitate deliveries or other services you may request, such as product or component registration, maintenance, warranty service, and financing, leasing or credit services.
- Customer Support. To provide customer support services, including monitoring and managing the health of your equipment, delivering upgrades and product improvement communications, conducting diagnostics and repairs, and carrying out product safety-related campaigns and recalls.
- Marketing. To personalize and improve your website experience, communicate offers for products and services from us or our business partners, including offers based on your interests, characteristics, and/or location; to administer surveys, loyalty programs, and other promotional events; and to provide other information of interest to you, such as company news, announcements, and reminders. - Human Resources. To evaluate your experience for a job opening
- General Business Purposes. To accomplish general business tasks such as payment processing, financial account management, payment collections, product research and development, product safety, product lifecycle management, contract management, website administration, web-forum management, order or contract fulfillment, analytics, fraud prevention, corporate governance, reporting and legal compliance.
- As Otherwise Disclosed. To accomplish any other purpose that we may describe when you provide us with your Personal Information.
The above Purposes may be necessary for us to enter or perform a contract to which you are a party, comply with a legal obligation to which we are subject, protect our vital interests, or otherwise pursue legitimate business purposes and objectives. We may also seek your consent to process your Personal Information in a way other than described above.
4. What About Non-Personal Information?
We also collect "Non-Personal Information," defined as any information that does not relate to an identified or identifiable natural person, such as:
- cookies and other tools, when used in a non-identifiable way;

We collect Non-Personal Information in the same ways we collect Personal Information. Because Non-Personal Information does not personally identify you, we may use and disclose it for any purpose, including to improve our products and services, to create and publish reports, and to conduct statistical analysis about our customers and equipment.
We may combine Non-Personal Information with Personal Information, in which case we will treat the combined information as Personal Information.
5. When Would We Disclose Your Personal Information, and to Whom?
We may disclose your Personal Information as follows:
- to our affiliated companies, suppliers, authorized dealers and distributors, and business partners, to accomplish the Purposes or as you authorize or request.
- to our service providers to fulfill the Purposes on our behalf, subject to them being bound by law or contract to treat your information and data with the same level of protection that we do and to use it only in accordance with our instructions.
- as needed to sell or transfer business assets, to enforce our rights (including any rights granted under any contract we or any of our affiliates have entered with you), to protect our property, or to protect the rights, property, or safety of others, or as needed to support external auditing, compliance, and corporate governance functions.
- when required to do so by law, such as in response to a subpoena, including to law enforcement agencies and courts in the countries where we operate.
6. Would We Ever Sell Your Personal Information?
No. We do not sell our customers’ Personal Information to third parties, nor do we share their Personal Information for cross-context behavioral advertising purposes.
7. How Long Will We Keep Your Personal Information?
We will keep your Personal Information as long as necessary for the relevant Purpose, and no longer. We keep different types of Personal Information for different lengths of time, depending on the Purpose(s) for which it was collected and the unique circumstances of your situation. 8. Automated Data Collection Technologies
When you visit our website, we may collect certain information from you via automated data collection technologies such as cookies, flash cookies, web beacons, server logs and geolocation.

In many cases, the information we collect using cookies and other tools is only used in a non-identifiable way, without reference to Personal Information. For example, we use information about website users to optimize our websites and to understand website traffic patterns. And if the settings on your mobile devices permit our mobile applications (if any) to collect location information, we will collect that information automatically. We have relationships with third-party advertising companies to perform tracking and reporting functions for our web processing. These third-party advertising companies may place cookies on your computer so they can display targeted advertisements to you. These third-party advertising companies should not collect Personal Information in this process, and we do not give Personal Information to them as part of this process. That said, we do not control these those advertisers may collect Personal Information about you through other means, outside your use of our website, in accordance with those advertisers’ privacy policies and practices or with the policies and practices applicable to the third-party websites where those advertisers serve their ads. To opt out of marketing emails, you may click the "unsubscribe" link at the bottom of marketing emails we send you. For example, we will always send you a confirmation when you make a purchase.

For Persons in the EU and UK
The European Union’s General Data Protection Regulation (“GDPR”) and the United Kingdom’s retained version of that legislation provide EU and UK data subjects the following rights:
(a) Right to Object to Processing: Allows you to object to our processing of your Personal Information carried out based on our legitimate interests, to carry out tasks in the public interest, or to exercise official authority. In cases where you object to our processing of your Personal Information for direct marketing purposes, the processing will cease.
(b) Right to Access: Allows you to request information from us about the Personal Information we have collected from or about you, including what data we have and how and why it is being processed.
(c) Right to Rectification: Allows you to correct or supplement your Personal Information where it is inaccurate or incomplete.
(d) Right to Erasure: Allows you to request that we erase Personal Information about you that we have in our possession.

For California Residents
California Civil Code Section § 1798.83 permits California residents using our website to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please contact us using the information below.
The California Privacy Rights Act of 2020 grants California residents the following rights over their Personal Information:

(b) Right to Know (Sales, Sharing, and Disclosure): From a business that sells, shares, or discloses Personal Information about a California resident for a business purpose, the resident may request and have disclosed: 1) the categories of Personal Information collected about him or her, 2) the categories of that resident’s personal information the business sold or shared and to/with whom, and 3) the categories of that resident’s personal information the business disclosed for a business purpose and to whom.
(c) Right to Correction: California residents have the right to request that a business that maintains inaccurate personal information about them correct that inaccurate personal information.
(d) Right to Deletion: California residents have a limited right to request that a business delete any Personal Information about them which the business has collected from or maintains about them.
(e) Right to Opt-Out of Sales and Sharing of Personal Information: California residents have the right, at any time, to direct a business that sells Personal Information about them to third parties not to sell or share their Personal Information. We do not sell our customers’ Personal Information to third parties.
(f) Right to Limit Use of Sensitive Personal Information: California residents have the right to request that a business that collects sensitive personal information for purposes of inferring their characteristics use or disclose that information only as necessary to perform the services or provide the goods requested by that resident, and for other limited purposes specified by California law.
(g) Right to Opt-In: California residents less than sixteen years of age have the right to have businesses refrain from selling their Personal Information to third parties without their consent, or, for California residents less than thirteen years of age, without the consent of their parents. We do not intend to collect Personal Information about persons younger than thirteen years of age and do not sell our customers’ Personal Information to third parties.
(h) Right to Non-Discrimination: California residents have the right not to be discriminated against for exercising their rights under the California Consumer Privacy Act.
Discrimination includes, but is not limited to:
- Denying goods or services to the individual.
- Charging different prices or rates for goods or services, including via discounts or other benefits or imposing penalties.
- Providing a different level or quality of goods or services to the individual.
- Suggesting that the individual will receive a different price or rate for goods or services or a different level or quality of goods or services. Please note that discrimination does not include offering a different price, rate, level, or quality of goods or services to individuals who have exercised their rights if the difference in offering is directly related to the value provided to the business by the individual’s data.
(i) Right to Notice of Financial Incentives: California residents whose Personal Information we collect have a right to be notified of any financial incentive programs available to them from us related to the collection, sale, or deletion of Personal Information. An individual must consent and opt into any such financial incentive program before being enrolled and has a right to receive from us a clear description of the terms of the program. Consent to enrollment in any financial incentive program may be revoked at any time.
To fulfill a request to exercise the rights described in (a)–(d) above, we must receive a verifiable request from you or someone authorized to submit the request on your behalf. To submit a request, please contact us using any of the means described in the “How to Contact Us” section below.
To prevent fraudulent requests and unauthorized use of Personal Information, we may request additional information to help verify your identity before processing a request, such as a copy of your driver’s license, passport, or other government-issued identification. You may obscure parts of the document (e.g., ID number), as long as the remaining information identifies you. You may also obscure identifying photographs, except when requesting access to data that includes photographs of you. If no such document is available to you, that information should be included in your initial request so that we can work with you to promptly verify your identity by other means. We will maintain records of all requests for at least 24 months, as required by the California Privacy Rights Act.
If you wish to appoint another person to submit a request on your behalf, we must, in addition to verifying your identity and the identity of your appointee, receive a copy of a document signed by you, authorizing your appointed agent to make the request on your behalf.
10. Information and Data Security
We have implemented an industry-standard data security program to reasonably safeguard Personal Information. However, no data security program is foolproof, nor is transmission of information over the Internet completely secure. TMG Industrial USA is headquartered in the United States of America, but our parent company is located in Canada, and our affiliated companies (including companies under common control) and independent authorized dealers may be located in countries throughout the world.
Personal Information may be accessed in or transferred to the United States or Canada or to our affiliates, authorized dealers, and data processors elsewhere in the world for the Purposes described in this Privacy Policy. 12. Privacy Policies of Third Parties
This Privacy Policy only addresses the collection, use, and disclosure of information and data by us and our controlled affiliates. We do not intend to collect Personal Information from children aged 13 and under on our website. If we discover that we have collected personal information from anyone under 13, we will delete it promptly.

This Privacy Policy may be amended from time to time to reflect new or different privacy practices. We will place a notice on our homepage as possible when we make material changes to this Privacy Policy.
